A federal judge has refused to grant an immediate hearing for a Plainfield Township athletic store and a lacrosse equipment manufacturer that are suing the NCAA, contending a rule change will destroy their business and cost players $58 million.
Athlete’ Connection and Warrior Sports Inc., part of the New Balance chain, claimed they needed a court injunction to block a regulation shrinking the size of the head for lacrosse sticks in 2010.
Warrior argued that it needed to block the rule before October in order to avoid spending millions of dollars to retool manufacturing operations.
U.S. District Judge Janet Neff declined to hear the request, noting that the firm and store waited six months to file a lawsuit against the collegiate sports association. No future court dates have been set.
